Back to the homepage

These Terms of Service set out the rules that apply when you use the website at tylerfilms.autos, when you contact Tylersfilms LLC about a production, and when you book the studio floor, a coverage crew, a scouting run, an edit suite session or equipment checkout. They form a binding agreement between you and Tylersfilms LLC, a production company at 254 N 3050 W, Layton - 84041-8823, United States (US).

Please read these terms before you confirm a booking. If you place a booking on behalf of a company or another person, you confirm that you have the authority to accept these terms for that organisation. If you do not agree with any part of these terms, do not use the website and do not confirm a booking, and speak to the studio team so that any concerns can be addressed directly.

About the Company

Tylersfilms LLC is a limited liability company registered in the United States with its studio floor at 254 N 3050 W, Layton - 84041-8823, United States (US). The company provides production services including commercial shoot days, event coverage, studio floor rental, location scouting, edit suite sessions and equipment checkout. The booking email is bookings@tylerfilms.autos and the studio telephone number is +18069326943.

The website is maintained on behalf of the company by Tyler Films, the developer named on the site. These terms govern the services supplied by Tylersfilms LLC. They also govern the use of the website itself, which is published by the company for information and enquiry.

Acceptance of These Terms

You accept these terms when you use the website, when you send an enquiry through the contact form or by email, and when you confirm a booking. A booking is confirmed when the studio team issues a written confirmation that names the service, the dates and the price, and you accept that confirmation. An enquiry alone does not create a booking.

These terms work alongside the written lane plan and the booking confirmation for each job. Where a lane plan or a signed agreement sets out something different, that document takes priority for the job it describes. Where there is a conflict that the documents do not resolve, these terms apply.

You must be at least eighteen years old to confirm a booking on your own behalf. A person under eighteen may be involved in a production where a parent or guardian has given the consents required for that production.

Bookings and Confirmations

A booking request should include the service required, the dates, the expected crew size, the shot list or run of show, and the deliverables. The studio team will check the calendar and reply with a lane plan, a price and any conditions. A provisional hold may be offered while you finalise your side, and the hold expires on the date stated in the confirmation.

Confirmed bookings must be accepted in writing. The confirmation is issued by email, and it becomes effective when you reply to accept it, when you pay the deposit, or when you arrive for the booked block, whichever happens first. If you do not accept within the hold period, the date may be released to another crew.

You are responsible for making sure that the details in the confirmation are correct, including the dates, the service, the access times and the named contact. Tell the studio immediately if something is wrong, because a late correction may not be possible once the schedule is fixed.

Studio Floor Use

The studio floor is rented for the block stated in the confirmation. Load-in opens one hour before the block and load-out must be complete by the end of the block unless a longer window is agreed in writing. The floor manager will show your crew the safe routes, the cable runs and the loading door when you arrive.

The lane, the light stand row, the slate rack and the dressing well are included in a floor rental. Moving stands, re-taping cable runs or fixing anything to a wall must be approved by the floor manager. The floor must be left in the condition in which it was found, with rubbish bagged and any house equipment returned to its labelled position.

Open flames, smoke effects, water effects and any activity that creates dust or residue require written approval before the shoot day so that the room can be prepared and the next booking protected. Anything that damages the floor, the paint or the fittings may be charged at the cost of making it good.

Commercial Shoot Days

A commercial shoot day includes the studio floor, the pre-rigged light stand row, the slate rack and a floor manager for the booked hours. The plan is built from the shot list provided in the request. Changes to the shot list on the day are welcome where the schedule allows, but a change that requires a new position or additional crew may be charged as extra time or extra service.

The client is responsible for the creative direction, the product, the wardrobe and the talent, and for obtaining the releases needed for the intended use of the film. The studio supplies a standard talent release on request. The client must ensure that any product or brand shown in the shoot is cleared for the intended use.

Where the shoot is expected to run beyond the booked hours, the client must tell the floor manager as early as possible. Overtime is charged at the rate stated in the confirmation and is subject to the floor still being available after the block.

Event Coverage Crews

Event coverage includes the crew, the kit listed in the confirmation and the agreed hours at the venue. The client is responsible for arranging venue access, power, parking and any permission needed to film at the venue. The studio will confirm the run of show and the filming zones in advance, and the crew will work within them.

Where an event runs late or changes venue at short notice, the crew will make reasonable efforts to adapt. Additional hours or travel beyond the agreed scope are charged at the rate in the confirmation. Footage from the event is delivered to the client, and the client is responsible for the notice to attendees and for the consents required for any later use of the film.

Location Scouting Runs

A scouting run is a professional service that produces a working folder of site notes and images. It is not a guarantee that a site will be available, affordable or suitable for the shoot. Access to a site is arranged with the site owner or manager, and the studio cannot promise access where a third party declines.

The scouting folder is prepared for the client that booked the run. It may be used by the client and its production team for planning. It may not be resold, published or shared with a competing production without written permission. The studio retains a copy for its own records in line with the retention rules in the privacy policy.

Edit Suite Sessions

Edit suite sessions are booked by the hour, the day or an agreed deliverable window. The session includes the room, the calibrated monitors and access to the project library for the footage assigned to the job. The client is responsible for the edit brief, the approvals and the final sign off.

An editor may be supplied as part of the booking or the client may bring an editor. Where the client brings an editor, the studio will make the project files and the room available but is not responsible for the creative decisions made in the room. Additional revision rounds beyond the agreed scope are charged at the rate in the confirmation.

Project files remain in the studio library for the retention period. The client should take delivery of the final files before the session closes, and should keep its own copy of any master it needs for longer.

Equipment Checkout

Equipment is checked out against a named crew member who is responsible for its safe keeping and return. The checkout sheet records the condition of each item at collection and at return. Items must be returned on the date stated on the sheet, clean and complete, in the case supplied.

A damage deposit may be held for items that leave the building. The deposit is returned when the items come back in the recorded condition, less any amount needed to repair or replace an item that is damaged, lost or returned late. If the deposit does not cover the loss, the balance is payable as an invoice.

Equipment may not be sub-rented, taken outside the agreed area or modified without written permission. Any fault discovered during use must be reported to the studio as soon as it is safe to do so.

Pricing and Payment

Prices are stated in the confirmation for the service and the block booked. Prices cover the items named in the confirmation and nothing else. Additional crew, additional hours, extra delivery formats, travel beyond the agreed area and replacement of damaged equipment are charged separately at the rates stated or, where no rate is stated, at a reasonable market rate.

A deposit is usually required to secure a date, with the balance due before the shoot day unless the confirmation states otherwise. Long projects may be invoiced in stages. Invoices are payable within the period stated on the invoice, and late payment may attract the interest or fee set out in the confirmation.

Where a payment is made by card, it is processed by a payment provider. The client is responsible for any bank charge or currency cost associated with the payment. Prices are exclusive of any tax that the law requires the studio to add.

Cancellation and Rescheduling

A confirmed booking may be rescheduled once at no charge where the studio receives written notice more than seven days before the booked block and the new date is available. A second reschedule, or a reschedule inside seven days, may be charged at the rate set out in the confirmation.

Where a booking is cancelled, the deposit is refundable in part according to how close the cancellation falls to the booked date. A cancellation inside forty eight hours of the block may forfeit the deposit, because the date has been held and other crews have been turned away. A cancellation after the crew has left the studio for an event or a location shoot may be charged in full where the cost of the day has already been incurred.

The studio may cancel or reschedule a booking where the floor becomes unsafe, where a serious incident occurs, or where a force outside the reasonable control of the company prevents the work. In that case a fair refund or a priority replacement date will be offered.

Client Material and Consents

The client is responsible for the material it brings to the studio, including scripts, music, images, products and personal data about the people involved. The client confirms that it has the rights and consents needed to use that material and to have it filmed, edited and delivered. The studio is not required to investigate the ownership of a script or a music track supplied by the client.

For event coverage, the client is responsible for the notice to attendees and for any consent needed from a speaker or a guest. For commercial work, the client is responsible for the releases from talent and for the clearance of any brand or location shown. The studio will cooperate with reasonable requests to support those consents but cannot grant them on the client behalf.

The studio may refuse to film or edit material that it believes is unlawful, defamatory or likely to cause serious harm. If that happens, the studio will explain the reason and will discuss a workable alternative where one exists.

Deliverables and Acceptance

The deliverables for a job are named in the confirmation. A deliverable is accepted when the client confirms it in writing or when seven days pass from delivery without a written objection that identifies a specific fault. Minor preferences that were not part of the brief are handled as a new revision rather than as a fault.

Where a fault is reported, the studio will correct it at no charge where the fault is the studio responsibility. Where the request is a change of direction, the studio will quote the work before proceeding. A client may not withhold payment for a deliverable that meets the brief because of a change of mind.

Ownership and Licence

The studio owns the equipment, the studio floor, the lane plan and the working materials it brings to a job. The client owns the footage and the finished deliverables once the invoice for the job has been paid in full, unless a written agreement says otherwise. Until payment is complete, the studio holds the footage and the deliverables as security for the unpaid amount.

The client grants the studio a limited licence to keep the footage for the retention period and to use short excerpts of the work on the studio own channels where permission has been recorded. That licence does not allow the studio to sell the footage or to hand it to another client.

The website text, layout and code remain the property of Tylersfilms LLC and its developer. No part of the website may be copied, republished or used to build a competing site without written permission.

Safety and Site Rules

Everyone on the studio floor must follow the safety briefing and the direction of the floor manager. Cables are taped and routes are marked for a reason. Stands must be weighted, lights must be handled by trained crew, and nothing may be hung from a fitting that is not rated for the load. A visitor who sees an unsafe condition should report it immediately.

Children on the floor must be supervised by a parent or guardian at all times. Vehicles must be parked where directed and must not block the loading door. Smoking is not permitted inside the studio. Food and drink are kept away from the equipment benches.

The studio may stop a shoot or ask a person to leave where safety is at risk or where the site rules are being ignored. A stoppage caused by a failure to follow the rules is not a ground for a refund.

Limitation of Liability

The studio provides its services with reasonable skill and care. To the extent the law allows, the studio is not liable for indirect or consequential loss, loss of profit, loss of opportunity or loss of reputation arising from a booking, a shoot, a delivery or the use of the website. The studio is not responsible for a delay caused by a venue, a supplier or a force outside its reasonable control.

Where the studio is liable for a loss, the liability for that booking is limited to the amount paid for the service that caused the loss, unless a different limit is agreed in writing or the law does not permit the limit. Nothing in these terms excludes liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be excluded.

The client is responsible for insuring its own equipment, products and people on the floor. The studio does not insure a client camera, a client hard drive or a client product, and the client should check its own cover before the shoot day.

Indemnity

The client will compensate the studio for a loss, a claim or a cost that arises from the client material, from a use of the footage that the client was not entitled to make, from a breach of these terms by the client, or from damage caused by the client crew to the studio or to a third party. This includes reasonable legal costs where a claim is defended.

The obligation is reduced where the loss was caused or made worse by the studio own negligence. The client must tell the studio promptly about any claim that might trigger this section so that the two sides can decide how to respond.

Confidentiality

Each side will keep the confidential information of the other side private. For the studio, that includes a client script, product plans, pricing and unreleased campaigns. For the client, that includes the lane plans, the internal working methods and the pricing of the studio. Confidential information may be shared with the people who need it to run the job and with professional advisers under a duty of confidence.

The duty does not cover information that is already public, that was lawfully received from another source, or that must be disclosed by law. The duty continues for three years after the job ends, or longer where the information remains commercially sensitive.

Acceptable Use of the Website

You may read the website, use the contact form to send a genuine enquiry, and share a link to a page. You may not attempt to gain unauthorised access to the site or its systems, send automated bulk requests, introduce malicious code, scrape the content for a competing service, or use the site in a way that interferes with another person use.

The content on the website is provided for information. It is not a quote, a warranty or a promise that a date is available. A booking is only formed in the way described in the booking section above.

If you find a security issue, report it to bookings@tylerfilms.autos before disclosing it publicly, and allow a reasonable time for a fix.

Suspension and Termination

The studio may suspend or end access to the website or refuse a booking where these terms are breached, where a safety risk is created, or where a payment is seriously overdue. Where a booking is ended for a breach by the client, the amount already paid for work performed is not refunded and any balance for work performed remains due.

A client may end a booking under the cancellation section. Either side may end the agreement immediately where the other side becomes insolvent or commits a material breach that is not corrected within a reasonable period after written notice.

Sections that by their nature should survive the end of the agreement, including ownership, confidentiality, indemnity and liability, continue to apply after the job is closed.

Governing Law and Disputes

These terms are governed by the laws of the State of Utah in the United States, without regard to conflict of law rules. The courts of Utah have jurisdiction over a dispute that cannot be resolved between the parties, unless the law gives a consumer a right to bring a claim in another forum.

Before starting a formal claim, the parties will try to resolve the matter by discussion. A written notice of the dispute should be sent to the studio address, setting out the facts, the amount in dispute and the outcome sought. The studio will reply within a reasonable period and will meet to discuss a resolution where that is practical.

Nothing in this section prevents a party from seeking urgent relief from a court where a delay would cause harm.

Changes to These Terms

The studio may update these terms when a service changes, when the law changes or when a clearer wording is needed. The date at the top of the page shows the current version. A booking is governed by the version in force on the date the booking was confirmed, so a later change does not alter the terms of a job that was already agreed.

Where a change is material, the studio will make it clear on the website and will send a short note to a client with an upcoming booking where an email address is held.
